1. About us

The website is owned and operated by Nikhil Gupta, sole proprietor, trading as Poshanful, with its registered office at C103, Ground Floor, Mayfield Garden, Sector 50, Gurgaon, Haryana 122018, India. Contact us at support@poshanful.com or 8839393977.

2. Definitions

• "Products" means the groceries, staples, edible oils, spices, packaged foods and other items listed for sale on the website.
• "Order" means a request submitted by you to purchase one or more products.
• "Content" means all text, images, logos, descriptions and graphics on the website.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872 to place an order. We currently accept orders for delivery within India only.

4. Your account

Some features require you to sign in using a one-time password (OTP) sent to your registered mobile number or email. You are responsible for keeping your account and login codes confidential and for all activity under your account. We may suspend or terminate accounts we reasonably believe have been used for fraudulent, unlawful or abusive activity.

5. Products, descriptions and pricing

• All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise. Delivery charges, where applicable, are shown at checkout before you pay.
• We make every effort to describe and photograph products accurately. Packaging, weight, colour and appearance may vary slightly, and images are for representation only.
• Products are subject to availability and seasonal stock. We may limit quantities, or correct any error in price or description, even after an order is submitted.
• If a pricing error is found after you order, we will inform you and let you confirm at the correct price or cancel for a full refund.

6. Orders and acceptance

Your submission of an order is an offer to buy. All orders are subject to acceptance by us, and an order is only confirmed when we send an order confirmation and/or dispatch notification. We may refuse or cancel any order for reasons including unavailability of stock, pricing or product errors, suspected fraud, or a delivery address we cannot service. Where we cancel a prepaid order, we refund the amount paid in full.

7. Payments

• Payments are processed through third-party payment gateways. We do not receive or store your card, UPI, net-banking or wallet credentials.
• We accept the online payment methods and Cash on Delivery options shown at checkout, where available for your pincode.
• You agree to pay the full amount shown at checkout, including any delivery charges. If a payment fails or is reversed, we may hold or cancel the related order.

8. Shipping and delivery

We deliver across India subject to serviceability of your pincode. Delivery timelines, charges and free-delivery thresholds are set out in our Shipping & Delivery Policy. Estimated delivery times are indicative and not guaranteed. Risk in the products passes to you on delivery.

9. Cancellations, returns and refunds

Cancellations, returns, replacements and refunds are governed by our Refund & Cancellation Policy. Because we sell food and grocery items, certain hygiene and perishability conditions apply.

10. Acceptable use

You agree not to:

• Use the website for any unlawful, fraudulent or harmful purpose, or in breach of any applicable law.
• Place speculative, false or fraudulent orders, or use another person's payment details without authority.
• Attempt to gain unauthorised access to, interfere with, or disrupt the website, its servers or connected systems.
• Copy, scrape, republish or exploit any content without our prior written permission.
• Upload content that is defamatory, obscene, infringing or otherwise objectionable.

11. Intellectual property

All content on the website, including the Poshanful name, logo, design, text and images, is owned by or licensed to us and protected by applicable intellectual-property laws. You are granted a limited, non-exclusive, non-transferable licence to access the website for personal, non-commercial use only.

12. Reviews and user content

If you submit a review, comment or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display and reproduce it in connection with our business. You are responsible for what you submit and confirm it is accurate, lawful and does not infringe any third party's rights. We may remove content at our discretion.

13. Third-party links and services

The website may link to or rely on third-party websites and services (such as payment gateways, couriers and messaging providers). We are not responsible for their content, policies or practices, and your use of them is at your own risk.

14. Disclaimers

The website and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties not expressly stated here. Nothing in these Terms limits your statutory rights as a consumer under the Consumer Protection Act, 2019 and other applicable Indian law.

15. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with any order or your use of the website will not exceed the amount you paid for the products giving rise to the claim. We will not be liable for indirect, incidental, special or consequential loss, or loss of profit, data or goodwill.

16. Indemnity

You agree to indemnify and hold harmless Nikhil Gupta and Poshanful, and our associates, from any claim, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms or misuse of the website.

17. Force majeure

We will not be liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, floods, strikes, transport disruption, power or internet failure, pandemics, or acts of government.

18. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to the grievance process below, the courts at Gurgaon, Haryana shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the website.

19. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date and will apply to orders placed after it is posted.
